GPSR Basics

What is GPSR and when did it come into force?+

GPSR (General Product Safety Regulation, EU 2023/988) replaced the older GPSD and came into full force on December 13, 2024. It applies to all businesses selling physical products to EU consumers — including non-EU businesses selling online.

Does GPSR apply to my online store if I am based outside the EU?+

Yes. If you sell physical products to EU consumers from the US, UK, China, or any other country, GPSR applies. You must also identify an EU Responsible Person (an EU-established entity) on your product pages.

Does GPSR apply to B2B sales?+

GPSR applies to products that will eventually reach consumers, even if the immediate sale is B2B. Wholesalers and distributors have GPSR obligations. Pure industrial products sold exclusively through professional channels may be exempt — but only if a consumer cannot realistically purchase from your store.

Do handmade or artisan products need to comply with GPSR?+

Yes. GPSR applies to handmade products sold commercially to EU consumers. Even a sole trader or artisan must ensure products are safe, maintain basic documentation, and display their name and contact details on product listings.

Does GPSR compliance require third-party certification?+

GPSR itself doesn't universally require third-party certification — the obligation is to ensure products are safe and documented. However, specific categories like toys and electrical goods require CE marking and conformity assessment under product-specific EU legislation.

Requirements

What information must appear on every product page?+

GPSR requires: (1) manufacturer legal name, (2) manufacturer postal address, (3) manufacturer electronic contact, (4) product identifier (SKU, batch number, or model number), and (5) mandatory safety warnings. For non-EU manufacturers, an EU Responsible Person's name and address must also be displayed.

What is an EU Responsible Person under GPSR?+

An EU Responsible Person is an EU-established entity that takes legal responsibility for GPSR compliance on behalf of non-EU manufacturers. They must hold a written mandate from the manufacturer, maintain technical documentation, and be identified on product pages. They can be your EU importer, an EU subsidiary, or a third-party RP service provider.

What is the difference between GPSR and GDPR?+

GPSR governs the physical safety of products sold to EU consumers. GDPR governs personal data collection and processing. They are separate regulations with separate compliance requirements — though cookie consent (required under GDPR's ePrivacy provisions) is also a signal EuroGPSR checks.

EAA & Accessibility

What is the EAA and when does it apply?+

The European Accessibility Act (EAA) requires ecommerce websites serving EU customers to meet WCAG 2.1 AA accessibility standards. It became enforceable for ecommerce services on June 28, 2025.

What WCAG 2.1 AA requirements apply to ecommerce under the EAA?+

Key requirements include: alt text for product images, keyboard navigation for all elements, visible focus indicators, colour contrast ratio 4.5:1 for normal text, associated labels for form fields, accessible button and link names, language declaration on the HTML element, and a skip navigation link.

What happens if my store misses the EAA deadline?+

National market surveillance authorities are enforcing EAA from June 2025. Non-compliant stores can face fines, orders to cease digital services in the EU, and reputational damage from public enforcement records. There is no grace period for ecommerce.

Fines & Enforcement

What are the GPSR fines?+

Fines are set by each EU member state. Germany: up to €100,000 per violation. France: up to €30,000 plus possible store closure. Netherlands: up to €900,000 for serious violations. Italy: up to €25,000. Enforcement began with formal warnings in Q1 2025.
