GPSR Compliance in Hungary

Hungary enforces GPSR through NFH, which coordinates with Czech ČOI, Polish UOKiK, and Austrian BMAW on cross-border cases. A non-compliant seller identified in one Central European country is likely to be investigated in neighboring markets too. Here's what you need to comply.

Who enforces GPSR in Hungary?

Hungary's enforcement is led by NFH at the national level, with significant cross-border cooperation with neighboring EU authorities. The regional coordination framework means that ecommerce compliance in Central Europe is increasingly treated as a bloc rather than separate country-by-country issues.

Consumer protection & GPSR

NFH

Nemzeti Fogyasztóvédelmi Hatóság (National Consumer Protection Authority) is the primary market surveillance authority. NFH enforces GPSR, consumer protection law, and coordinates with EU-level RAPEX for cross-border product safety issues.

Data protection (GDPR)

NAIH

Nemzeti Adatvédelmi és Információszabadság Hatóság is the Hungarian data protection authority. It enforces GDPR compliance including cookie consent, privacy notices, and data processing obligations for ecommerce stores.

Customs & tax enforcement

NAV

Nemzeti Adó- és Vámhivatal is Hungary's combined tax and customs authority. It handles border enforcement for non-compliant products arriving from outside the EU and oversees VAT and import obligations for cross-border ecommerce.

Product standards

NKFIH / MSZT

The National Intellectual Property Office and the Hungarian Standards Institution handle product standards and technical conformity. Relevant for product certification and CE marking requirements for specific product categories.

NFH coordinates with Czech, Polish, and Austrian authorities on cross-border cases

NFH actively participates in joint market surveillance operations with Czech ČOI, Polish UOKiK, and Austrian BMAW under EU coordinated enforcement frameworks. This means a non-compliant seller identified in one Central European country is likely to be investigated by authorities in neighboring markets. Sellers targeting Central Europe should treat regional compliance as a single issue, not country-by-country.

Hungary-specific compliance requirements

These requirements combine GPSR obligations with Hungary's Eker. tv. (e-commerce law), the Consumer Protection Act, and EU consumer rights directives. All apply simultaneously.

Product information in Hungarian

CRITICAL

All product safety warnings, instructions, and consumer-facing information must be in Hungarian (magyar). NFH enforces this requirement during market surveillance. This applies to product pages, packaging, instruction manuals, and all safety-related communications targeting Hungarian consumers.

Manufacturer or responsible person details

CRITICAL

Name, address, and electronic contact of manufacturer or EU responsible person must be visible on each product page under GPSR Article 9. NFH specifically checks for this during market surveillance operations.

Termékszám / azonosító (product identifier)

CRITICAL

Each product must carry a model number, EAN, or article reference enabling traceability under GPSR. This is required to enable swift action in recall situations and is checked by NFH during product safety inspections.

Impresszum (legal notice)

CRITICAL

Under Hungarian e-commerce law (Eker. tv.), online stores must display company name, registered address, adószám (tax number), cégjegyzékszám (company registration number), and contact information. The impresszum must be accessible from every page of the store.

Elállási jog (right of withdrawal)

IMPORTANT

Hungarian consumers have a 14-day right of withdrawal under 45/2014. (II. 26.) Korm. rendelet. This must be stated in Hungarian before checkout and included in order confirmation communications. Failure to inform consumers extends the withdrawal period to 12 months.

GDPR cookie consent (NAIH)

IMPORTANT

NAIH (Nemzeti Adatvédelmi és Információszabadság Hatóság) enforces GDPR in Hungary. Cookie banners must offer genuine opt-out. Privacy policy in Hungarian required, listing NAIH as supervisory authority and describing all data processing activities.

The EU Responsible Person for non-EU sellers

If your business is based outside the EU and you sell physical products to Hungarian consumers, GPSR Article 4 requires an EU-established responsible person. This person handles safety reporting, recall coordination, and communication with NFH on your behalf.

Importer

An EU-based company that purchases your products and resells them within the EU. The importer automatically becomes the responsible person and must have their details visible on product pages.

Authorised representative

A company or individual formally mandated via written appointment to act as your EU responsible person. They handle regulatory communication with NFH on your behalf.

Fulfilment service provider

An EU-based warehouse or fulfilment centre that physically handles your products can serve as responsible person under GPSR. Practical for non-EU brands using EU logistics.
