Who enforces GPSR in Portugal?

Portugal's enforcement structure is led by ASAE — an authority that stands out in the EU for its proactive approach. ASAE does not wait for consumer complaints. It actively scans ecommerce sites and initiates enforcement based on its own surveillance, including stores based outside Portugal.

ASAE

The Autoridade de Segurança Alimentar e Económica is Portugal's main product safety and market surveillance authority. It has jurisdiction over food safety and economic activity — including ecommerce product compliance. ASAE regularly publishes reports on its ecommerce enforcement operations.

Consumer protection policy

DGConsumidor

The Direção-Geral do Consumidor coordinates consumer protection policy and works with ASAE on enforcement priorities. It handles the national Consumer Arbitration Centres and manages cross-border consumer disputes through the European Consumer Centres network.

Data protection (GDPR)

CNPD

The Comissão Nacional de Proteção de Dados is Portugal's data protection authority. It enforces GDPR compliance, including cookie consent, privacy policies, and data processing disclosures — all directly relevant to ecommerce operations targeting Portuguese consumers.

Customs & fiscal compliance

AT (Autoridade Tributária)

Portugal's Tax and Customs Authority intercepts non-compliant products at the border and enforces VAT and import obligations. Non-EU stores shipping directly to Portuguese consumers may face scrutiny for both product safety compliance and customs documentation.

ASAE proactively scans ecommerce sites — no complaint required

Unlike some EU authorities that only act on consumer complaints, ASAE runs systematic online sweeps and publishes its findings. It has explicitly targeted cross-border ecommerce sites, including stores operating in Portuguese from outside the EU. A non-compliant store selling to Portugal does not need to be reported to be found.

Portugal-specific compliance requirements

These requirements combine GPSR obligations with Portugal's Lei de Defesa do Consumidor and the Decreto-Lei n.º 7/2004 e-commerce regulations. All apply simultaneously.

Product information in Portuguese

CRITICAL

Portuguese is mandatory for all consumer-facing product content sold in Portugal. Lei n.º 67/2003 and the Lei de Defesa do Consumidor both reinforce this. Safety warnings, instructions for use, and manufacturer or responsible person contact details must all appear in Portuguese — not Spanish, not English, and not Brazilian Portuguese approximations.

Manufacturer or responsible person details

CRITICAL

The name, registered address, and electronic contact of the manufacturer or EU responsible person must be visible on each product page. ASAE specifically checks for this during its proactive online surveillance sweeps. Missing or incomplete information is treated as a serious violation.

Product traceability references

CRITICAL

Each product listing must carry a model number, article reference, or batch identifier that allows the product to be traced back to the manufacturer. This is required by GPSR for market surveillance purposes and enables swift action in recall situations.

Informação legal (legal notice equivalent)

CRITICAL

Under Decreto-Lei n.º 7/2004 (implementing the e-commerce directive), online stores must provide clear information about the service provider — full legal name, address, registration numbers, VAT number, and supervisory authority if applicable. This must be easily accessible, typically in a dedicated legal information page.

Direito de livre resolução (right of withdrawal)

IMPORTANT

Portuguese consumers have a 14-day right of withdrawal under Lei n.º 47/2014 (implementing the Consumer Rights Directive). The withdrawal conditions, deadline, and form must be provided in Portuguese before checkout and included in order confirmation communications.

GPSR product safety reporting contact

IMPORTANT

Consumers must be able to report product safety concerns through an accessible contact channel. ASAE recommends that this contact method be clearly labelled for product safety purposes and easy to find from any product page, not buried in a generic contact form.

The EU Responsible Person for non-EU sellers

If your business is based outside the EU — including Brazil, UK, or the US — and you sell physical products to Portuguese consumers, GPSR Article 4 requires an EU-established responsible person. This is especially critical for Brazilian ecommerce stores: the shared language makes Portugal an obvious target market, but EU product safety law applies in full regardless of where the seller is based. ASAE has specifically flagged non-EU Portuguese-language stores in its enforcement reports.

Importer

An EU-based company that purchases your products and resells them within the EU. The importer automatically becomes the responsible person and must have their details visible on product pages — replacing yours.

Authorised representative

A company or individual formally mandated via a written appointment to act as your EU responsible person. They handle recall coordination, safety reporting, and regulatory communication with ASAE on your behalf.

Fulfilment service provider

An EU-based warehouse or fulfilment centre that physically handles your products can serve as responsible person under GPSR. This is the most practical option for non-EU direct-to-consumer brands using EU logistics infrastructure.
