Who enforces GPSR in Sweden?
Swedish GPSR enforcement is shared between the consumer agency, the consumer ombudsman, and the data protection authority for digital compliance.
Consumer agency & market surveillance
Konsumentverket
Swedish Consumer Agency — the primary authority for product safety market surveillance. Actively monitors cross-border online sellers and can issue injunctions preventing continued sales of non-compliant products.
Legal enforcement
Konsumentombudsmannen (KO)
The Consumer Ombudsman can take legal action against companies violating consumer protection rules. Works alongside Konsumentverket and can bring cases to the Market Court (Marknadsdomstolen).
Data protection & cookies
IMY
Integritetsskyddsmyndigheten — Swedish data protection authority. Has issued fines to major companies for non-compliant cookie consent banners. Requires genuine opt-in consent — one of the stricter EU enforcers.
Market Court
Marknadsdomstolen
The Market Court can issue conditional fines (vite) against companies found in violation. Once a vite is issued, continued non-compliance triggers substantial financial penalties.
Swedish consumers are among the most complaint-active in the EU
Sweden has one of the highest consumer complaint rates per capita in Europe. A single non-compliant product page can generate multiple complaints to Konsumentverket. The agency is well-resourced and treats cross-border sellers the same as domestic ones — non-compliant stores outside Sweden are regularly targeted.
Sweden-specific compliance requirements
These requirements apply in addition to general GPSR rules — several are grounded in Swedish national law and cannot be satisfied by EU-generic compliance alone.
Swedish-language safety information
CRITICALSafety warnings, usage instructions, and manufacturer contact details must be provided in Swedish. The Marknadsföringslagen (Marketing Act) requires that marketing and consumer information is presented clearly in the consumer's language. English-only product pages are not sufficient.
Manufacturer or responsible person details
CRITICALName, registered business address, and an electronic contact must be clearly visible on each product page. For non-EU businesses, an EU-established responsible person must be identified. Konsumentverket specifically checks for this when investigating cross-border sellers.
Product traceability identifier
CRITICALA model number, batch number, or serial number must be displayed on each product page. Swedish market surveillance authorities require this to trace products back to the manufacturer in safety investigations.
Right of withdrawal (14 days)
CRITICALUnder Swedish Konsumentköplagen (Consumer Purchase Act) and EU directive, consumers have a 14-day right of withdrawal. A clear notice, model withdrawal form, and return instructions must be included in the order process and in order confirmation emails.
Clear pricing information (Prisinformationslag)
IMPORTANTSweden's Prisinformationslag (Price Information Act) requires that prices are clearly displayed including VAT and any additional charges. Misleading pricing — such as displaying ex-VAT prices to consumers — can trigger enforcement by Konsumentverket.
IMY-compliant cookie consent
IMPORTANTIMY (Integritetsskyddsmyndigheten — Swedish data protection authority) has issued fines to major companies for non-compliant cookie consent banners. Opt-in consent is required — pre-ticked boxes or implied consent are not valid. A privacy policy in Swedish is recommended.
The EU Responsible Person for non-EU sellers
If your business is based outside the EU (UK, US, China, etc.) and you sell physical products to Swedish consumers, GPSR Article 4 requires an EU-established responsible person. Konsumentverket checks for this when investigating complaints.
Importer
An EU-based company that buys from you and resells in the EU. The importer takes on the responsible person role automatically and must be named on product pages.
Authorised representative
A company or individual you formally appoint as your EU responsible person. They must hold a signed mandate and be reachable for regulatory communication from Swedish authorities.
Fulfilment service provider
An EU-based fulfilment warehouse can act as responsible person if they physically handle the products. Common for FBA-style cross-border setups selling into Sweden.
